Stoffels v Western Cape Minister of Local Government, Environmental Affairs
and Development Planning SCA Petition Dismissed

Our application for leave to appeal to the Supreme Court of Appeal was dismissed today.

We succeeded in the main application in Cape Town before Judge Schippers who refused the relief sought by the MEC to intervene in the Council of Oudtshoorn. Important constitutional issues regarding the powers and liabilities of the Speaker and the Council of Oudtshoorn and the MEC remain, and should be properly ventilated in the Constitutional Court. Based on legal advice we shall appeal to the Constitutional Court.
