11 February 2014
Stoffels v Western Cape Minister of Local Government, Environmental Affairs
and Development Planning SCA Petition Dismissed

Our application for leave to appeal to the Supreme Court of Appeal was dismissed today.

We succeeded in the main application in Cape Town before Judge Schippers who refused the relief sought by the MEC to intervene in the Council of Oudtshoorn. Important constitutional issues regarding the powers and liabilities of the Speaker and the Council of Oudtshoorn and the MEC remain, and should be properly ventilated in the Constitutional Court. Based on legal advice we shall appeal to the Constitutional Court.

Media release issued on behalf of the Speaker of the Oudtshoorn Municipality: Aldm John Stoffels

Counsel for the municipality informed the MEC earlier this evening:

Cc: ‘Elzanne Jonker’
Subject: Stoffels v MEC

Dear Madam,

Kindly find attach hereto press release issued by my client today, the content of which is self explanatory.

I hereby confirm that I received instructions to attend to the necessary in order to have the matter adjudicated in the Constitutional Court.

Kind regards,

Hardy Mills

  1. Comrades, is this not becoming a bit embaressing man?

We’ve made our point, let comrade Peter take out membership and let’s fight the by-election and win so that we can officially govern.
