Drewan Baird. Oudtshoorn. 25 November 2013. 16h35. Speaker John Stoffels issued the following media statement on Friday’s council meeting this afternoon:
I informed the Western Cape minister of local government on Thursday last week that I was to appeal the MacPherson v. Stoffels judgment of His Lordship Ashton Schippers; I filed the appeal on Friday morning.
I indicated on the very day of the judgement that I was considering an appeal. There can be no concerns about so called “delaying tactics”.
My appeal is a comprehensive document, addressing numerous aspects of the Schippers judgement, and was filed timeously.
The effect of my appeal is that the Schippers judgment is suspended until the appeals process is exhausted; or until the Court rules differently.
My application for leave to appeal, opposed by the minister, is scheduled before Schippers for Wednesday, November 27.
In the light of High Court Rule 49(11) I acted on Friday according to the status quo before the Schippers judgment and did not allow the votes of DA councillors Pierre Nel and Ben van Wyk, whose voting rights were suspended by council resolution on September 20 in anticipation of the minister’s ruling.
