Court Order by agreement
And… DA Councillors receive letters of intent by the municipality
to recover from them the legal cost in Stoffels v Van Wyk et al
Drewan Baird. Oudtshoorn. 13 September 2013.
18h35. The municipality this afternoon issued letters of intent to recover from the DA and Cope and the other four apostate ex-ANC Councillors who participated in the illegal meeting of May 31 the legal cost in Stoffels v Van Wyk et al.
11h30. Surely, by this time, the DA must be embarrassed beyond words.
The media – both local and national – trumpeted the news on May 31: The DA takes over the Oudtshoorn Council!
And at this time, after the devastating order by Mr Justice André le Grange on Tuesday, the fact that DA Councillors have to pay the cost of the legal battle about the failed May 31 coup is only mentioned in passing!
Talk about “objectivity”!
For sheer incompetence; and abject waywardness; and plain strategic deficiency the DA can NOT run Oudtshoorn. Given that the local DA receives advice, legal and strategic, from the Provincial DA Government – not the DA Leadership, the GOVERNMENT – one is obliged to assume that the DA can also not run the Western Cape Province, and God forbid, the country.
Mr Justice Robert Henney made an Order, by agreement of the parties, moments ago to set a Special Council Meeting for today week, Friday, September 20, to table, debate, and vote motions of no confidence in the Speaker, Mayor, and Deputy Mayor.
There can be no possible alternative but that the motions be voted on September 20. Any other outcome will be altogether unacceptable. This much Henney J made abundantly clear.
In the mean time it is rumoured that the municipality will issue letters of demand by Tuesday to the 12 DA Councillors, the Cope Councillor and the other four ex-ANC Councillors who joined the DA on May 31, and the DA for the payment of the legal cost in the Stoffels v Van Wyk and others matter. Early expectations are that each of the Councillors will have to contribute some R120,000.
Why is the DA yet again prepared to agree to a meeting time set by the ANC Coalition?
Come now! It is obvious! The DA is patently unsure of a majority. As in completely at sea. And without a paddle even. Or a dinghy. Or any flotation device.
It may “LOOK” as if the ANC is delaying a Special Council Meeting, but the DA is o, so glad to point a political greasy finger in the general direction of the ANC. The DA can not afford a Council Meeting right about now…
