The DA’s Registrar: Federal Legal Commission (and Shadow Deputy Minister of Justice and Constitutional Development; and Constituency Head for Cape Metro wards 65, 66, 67, and 73; and a member of the Magistrates Commission) objects to the first paragraph of yesterday’s story below.
Schafer says that “the application did not fail, and Rogers made no finding regarding urgency”.
She also stressed that the judge made no decision at all regarding urgency or on the merits.
“The application was in fact postponed sine die, in other words, indefinitely”, said Schafer.
I gladly publish Schafer’s comments and can only wish that the DA would also react as quickly to my requests for correction as I do to theirs!
But hey, I’m just a pain in the ass blogger, and the DA is a huge and virginal holder of most of life’s moral high ground…
Drewan Baird. Cape Town. 28 August 2013. 14h45. The DA’s urgent application to force a Special Council Meeting for tomorrow failed in the High Court this morning when Mr Justice Owen Rodgers found that no urgency attached to the matter.
Rodgers made an Order of Court that a Special Council Meeting is to be held on September 4, as the speaker announced yesterday, and that the Western Cape minister of local government may call a Special Council Meeting at his pleasure should the meeting of September 4 not take place, for whichever reason.
No order as to cost was made.
Good order finally took leave of the Oudtshoorn Council on May 31 when the DA, in concert with 5 rogue ANC Councillors, “took control” of Council.
So convinced was the “new order” that Theuns Botha, DA head of government business and actual provincial party boss, brazenly announced “as ons ‘n hofbevel moet kry (to oust the ANC administration) dan kry ons ma’ die hofbeveltjie”.
This was on May 31.
Since then the DA “took over” Council some three times.
The ANC still governs.
