Luiters sê dis onaanvaarbaar.

OO publiseer binne die volgende uur ‘n berig hieroor. Die ondersteuning van van der Westhuizen kan moontlik, in ‘n uiters vergewende en akkommoderende lig, verklaar word…
Intussen is die item oor die Paulse-appélsaak na die raad-in-komitee verwys.
OO weet egter reeds dat adv Shaheed Patel by die burgemeester aanbeveel het dat die appèl R2m sal kos, en dat dit R5m sal kos on Mnyimba uit te koop – daarom moet die appèl voortgaan!
12h15. An official vehicle for the Mayor is discussed…
Raadslid Roberts (DA): Besluite moet wetting en moreel wees maar R120 000 per jaar en R400,000 vir kn nuwe kar vir die burgemeester kan nie geregverdig word terwyl daar geld geleen moet word vir kapitaalprojekte nie.
Councillor Gunguluza interrupts him and asks him to make a point and a sugestion so that Council can make a decision.
Van der Westhuisen: Why does the Mayor need a vehicle? A vehicle is not necessary and is a luxury at this stage. The Mayor has a vehicle allowance and must use it to get from point a to b and the funds rather plowed back into the community. And – said van der Westhuizen, Council must bear in mind that it is in the process of of borrowing R40m.
Luiters: The vehicle is not a vehicle for Gordon April, but for anyone whom the Mayor sends to appointments. This vehicle will be there to fulfill and aid the council and committees. The vehicle will be the property of Council not of April.
Wagenaar: If he purchase of a vehicle can aid the council, the ANC supports the purchase of the vehicle. The vehicle must be used as a official vehicle and not be used for private of unofficial use
Donson (Icosa): The vehicle is official and the mayor must look good when he goes on official business to bring money to the Municipality. He mentions that Stellenbosch Municipality has two official vehicles.
Speaker: Oudtshoorn’s Mayor must have a safe, presentable vehicle.
Roberts: Proposes that vehicle not be purchased.
And of course, 13 votes to 12 carries the vote that an official vehicle will be purchased. A usage policy for the vehicle must be written.
11h36. Lott says that it is expected that the Auditor General has also exceeded his deadline and Oudtshoorn can expect results by the end of August 2012.
Once the report is available the necessary public participation processes and council feedback will proceed and decisions initiated will be rolled out.
McPherson wants to know why the financial statements were not brought before Council as the statements were in hand since February 2012.
11h30. Councillor van Wyk (DA)speaks to the raising of external loans to fund 2012/13 capital projects, and requests clarity on the R40m outstanding while the projects are complete and the books are finalised.
Long term debt may only be incurred for the financing of property debt, or if the CFO makes his intention public 21 days before taking up a loan.
The public and National Treasury was also not consulted as is demanded by law.
Wagenaar requests that the MM looks into other avenues of financial assistance, and that all Council is looking for, is capital to write of debt of R1m.
Councillor Mcpherson (DA) says that a.41A states that a Municipality must declare the Annual Financial Statements of the previous three years, and that this was not done.
Longterm debt of R97m already exists and now Council wants to incure another R37m debt. Council is therefore making false promises to the people about delivery. Council has too much debt and no financial institution will lend it money. The solution is to find alternative sources to fund Oudtshoorn’s capital projects.

Van der Westhuizen asks Luiters to keep himself respectable in his way of speach and to keep to the point. The Speaker agrees.
Lott responds: The report is a proposed information statement to explain why R27m is needed for the 2012/13 capital expenditure. The Financial Statements were handed in 7 months late to the Auditor General.
11h15. Wagenaar wants to know how it is allowed that that debt remains outstanding and why is it not monitorred and rectified.
An immediate enquiry must be launched into this matter and mechanisms must be built in to avoid tax evation.
The Speaker instructs Councillors to fulfill their oversight roles and to give feedback.

11h00. Councillor Fourie (DA) speaks to the Municipal Infrastructure Upliftment Grant and points out discrepensies in the financial figures between televant documentation and the reporting of the budget, He questions where the funds were applied.
The CFO, Deon Lott, explains that column one gives the total value registered amount of a project and the last column depicts the Cogta/NIC registered budgeted figure.
The figures are accepted and not contested.
The writting off of 2007 to 2010 rates and taxes; and household tarrifs debt is discussed.
Councillor Wildschut (DA) wants to know who was responsible for the collection of outstanding Rates and Taxes. He demands an enquiry and wants a report on what has been handed over and how much has been recouperated over these years.
Councillor Luiters (ANC) says that we are in an implementation phase and that the writing of of debt 2007/10 debt accounts are currently with attorneys Coetzee & Van der Bergh, and Avontuur en VenoteM
He also says that no household accounts be handed over to attorneys but that the nasional policy of indegent cases be dealt with constitutionally and sensitively.
Charlie Wagenaar (ANC) says that if this decision is not implemented, the poorest of the poor will be adversely affected. All outstanding tax of poor people must be removed from the attorneys files and written off.

Luiters says that those who can pay must pay their tax and those who can’t pay their tax must be exempted.
Councillor van der Westhuisen (DA) suggests a model be instituted to assist people to pay their taxes.
Luiters suggests a working session to put together a model of recouperation so that poor people are not just merely handed over to attorneys. The office of the CFO should launch this project.
Luiters urges that the debts of deceased and vanished citizens are also forfeited consistently to accross the race spectrum of Oudtshoorn.
