CHARGE 1

Transgression of section 32 of the Municipal Finance Management Act, 56 of 2003 in that you authorised a fruitless and wasteful expenditure of about R14 000-00 to BisiBee Guesthouse on or about 22 December 2008. It is alleged that this payment was not due or payable in terms of a contract or an approved policy of Oudtshoorn Municipality and that it was made in vain and could have been avoided had reasonable care been exercised.

ALTERNATIVE TO CHARGE 1

Financial misconduct in that on or about 22 December 2008 you approved the payment of R14 000-00 made to BisiBee Guesthouse. It is alleged that this payment was not due or payable in terms of a contract or an approved policy of Oudtshoorn Municipality.

CHARGE 2

Transgression of section 32 of the Municipal Finance Management Act, 56 of 2003 in that you recommended a fruitless and wasteful expenditure of about R16 500-00 to yourself on or about 4 February 2009. It is alleged that this payment was not due or payable in terms of a contract or an approved policy of Oudtshoorn Municipality and that it was made in vain and could have been avoided had reasonable care been exercised.

ALTERNATIVE TO CHARGE 2

Financial misconduct in that on or about 4 February 2009 you recommended the payment of R16 500-00 made to yourself. It is alleged that this payment was not due or payable in terms of a contract or an approved policy of Oudtshoorn Municipality.

CHARGE 3

It is alleged that this payment was not due or payable in terms of a contract or an approved policy of Oudtshoorn Municipality and that it was made in vain and could have been avoided had reasonable care been exercised.

Financial misconduct in that on or about 4 February 2009 you recommended the payment of R14 000-00 made to Wendy Nokojo (Head: Human Resources). It is alleged that this payment was not due or payable in terms of a contract or an approved policy of Oudtshoorn Municipality.

Transgression of section 32 of the Municipal Finance Management Act, 56 of 2003 in that you recommended a fruitless and wasteful expenditure of about R7 200-00 to Jerome Moses (Engineering Technician: Roads) on or about 4 February 2009. It is alleged that this payment was not due or payable in terms of a contract or an approved policy of Oudtshoorn Municipality and that it was made in vain and could have been avoided had reasonable care been exercised.

ALTERNATIVE TO CHARGE 4

Financial misconduct in that on or about 4 February 2009 you recommended the payment of R7 200-00 made to Jerome Moses (Engineering Technician: Roads). It is alleged that this payment was not due or payable in terms of a contract or an approved policy of Oudtshoorn Municipality.

CHARGE 5

Transgression of section 32 of the Municipal Finance Management Act, 56 of 2003 in that you recommended a fruitless and wasteful expenditure of about R7 500-00 to Aphiwe Mpolweni (Budget Officer: Finance Department) on or about 4 February 2009. It is alleged that this payment was not due or payable in terms of a contract or an approved policy of Oudtshoorn Municipality and that it was made in vain and could have been avoided had reasonable care been exercised.

Financial misconduct in that on or about 4 February 2009 you recommended the payment of R7 500-00 made to Aphiwe Mpolweni (Budget Officer: Finance Department). It is alleged that this payment was not due or payable in terms of a contract or an approved policy of Oudtshoorn Municipality.

CHARGE 6

Transgression of section 32 of the Municipal Finance Management Act, 56 of 2003 in that you recommended a fruitless and wasteful expenditure of about R9 000-00 to Brenvan Samuels (Officer: Supply Chain Managerment) on or about 4 February 2009. It is alleged that this payment was not due or payable in terms of a contract or an approved policy of Oudtshoorn Municipality and that it was made in vain and could have been avoided had reasonable care been exercised.

ALTERNATIVE TO CHARGE 6

Financial misconduct in that on or about 4 February 2009 you recommended the payment of R9 000-00 made to Brenvan Samuels (Officer: Supply Chain Managerment). It is alleged that this payment was not due or payable in terms of a contract or an approved policy of Oudtshoorn Municipality.

CHARGE 7

Transgression of Item 2(d) and / or 2(e) of the Code of Conduct for Municipal Staff Members in that Misconduct in that you did not act in the best interest of the employer and / or did not treat the applicants for the post of IDP Manager impartially and / or equally and / or without favour or prejudice when you acknowledged and / or recommended the appointment of Luvuyo Masola as IDP Manager on or about 10 December 2008.

ALTERNATIVE TO CHARGE 7

Misconduct in that you did not act according to the Selection criteria (paragraph 4.3) of the Appointment Policy of Oudtshoorn Municipality when you acknowledged and / or recommended the appointment of Luvuyo Masola as IDP Manager on or about 10 December 2008.

CHARGE 8

Gross negligence in the execution of your duties in that on or about 16 September 2008 you submitted a Legal Opinion: Claim against pension payouts – Mr C F van der Mescht where you did not take all the facts into consideration and / or did not offer the correct advice to the employer resulting in the employer not recouping the R638 165-00 with which Mr Van der Mesch was unlawfully enriched or had to be recovered in accordance with section 32 of the Municipal Finance Management Act, 56 of 2003.

FIRST ALTERNATIVE TO CHARGE 8

CHARGE 10

Misconduct in that on or about 8 December 2008 you gave the wrong information and / or advice to the Acting Municipal Manager in stating that the 2007/08 Annual Performance Report had to be tabled at the Council meeting in January 2008.

CHARGE 11

Financial misconduct in that on or about 8 December 2008 you proposed a deviation from the Supply Chain Policy in circumstances that did not comply with Item 36 of the Supply Chain Management Policy.

ALTERNATIVE TO CHARGE 11

When will you be able to accept the truth…… If all the ANC’s appointments to staff are so “capable” of executing their individual tasks, where then do all these childish and even stupid mistakes come in? How can you appoint someone to represent you if that person themselves are knee deep in corruption charges….. WOW….. Don’t you see the obviousness of the truth?

    You don’t bite the hand that feeds you, and we as tax paying citizens(the one giving the food) are constantly being robbed, deceived, and misled by our current municipality(the one who bites the hand)!

    In a nutshell, Zuma has indisputably been SA’s worst President ever.Mandela must be ashamed beyond words !

  6. Interesting. In some cases minicipalities lay charges of allegged misconduct so that they can settle with employees and give them golden hand outs. Or like in Eden as OO reported they the council, just condone these actions and everyone if happy.
