17h05. Die verhoor het vanmiddag ten einde geloop en uitspraak word sos vroeg as komende week verwag.

OO se bronne na aan die saak het vanmiddag gerapporteer dat regter Blignaut verskeie vrae aan die raad se advokaat gestel het en dat daar ‘n aanduiding is dat die uitspraak moontlik in Paulse se guns kan wees.

Paulse self het só gereageer: “I am optimistic that the appiontment of Thandikile will be set aside and will be directed to redo the process legaly and under specific directions of the court.The court wont order my appiontment.”

Regskenners met wie OO vanmiddag gesels het stem saam dat die hof beslis nie sal beveel dat Paulse aangestel word nie en dat die beste uitkoms vir Paulse inderdaad sal wees dat die proses van meet af aan begin word.

Intussen moet daar besef word dat Mnyimba eintlik ‘n onskuldige bystander is. Hy het in goedertrou aansoek gedoen vir ‘n pos en kan nie die skuld dra vir die raad se besluit nie.

Dit sou onregverdig wees as Mnyimba sonder werk sit nadat hy op Jansenville bedank het en die pos op Oudtshoorn opgeneem het.

Dit bring ons andermaal by dié punt: Raadslede se politiekery en knoeiery verwoes lewens!

Ons het béter raadslede nodig!

Whatever the judgement, this matter will cost ratepayers money – expense due to irresponsible Council decisions!

It may not even be possible to recover the expense from the ANC Councillors and their two lapdogs – Donson and Stoffels – because Councillors have specific privileges and immunities ito s28 of the Structures Act.

The Western Cape also has a provincial act – Privileges and Immunities Act – that may protect the errant Councillors.

Oudtshoorn’s residents and voters must wake up and smell the sewerage – it’s of little consequence to alert people to maladministration if voters simply return the perpetrators to office time and time again!

17h50. Die saak het vanoggend teen 11h30 in aanvang geneem en Paulse het sy betoog teen die etensuur afgehandel.

Die hof het die Wes-Kaapse Minister van plaaslike regering se regspan net na ete aangehoor en teen die einde van die dag was die raad se regsverteenwoordigers nog besig met hulle betoog.

Die saak word Vrydag hervat.

Bronne wat vertroud is met hierdie soort geding het aan OO gesê dat daar ‘n verwagting is dat die hof kan bevind dat die aanstellingsproses heropen moet word.

Die hof sal waarskynlik nié beslis dat Paulse aangestel word nie.

In só ‘n geval sal daar van voor af begin moet word met die anstelling van ‘n munisipale bestuurder, en moontlik ‘n direkteur korporatiewe dienste.

Hoe dit ook al sy, die ANC kos Oudtshoorn se belastingbetalers emmers vol geld.

Die saak dien voor regter André Blignaut. Adv Ismail Jamie verskyn vir die raad en adv Con Joubert vir Paulse.

14h55. ANC Councillors are at this very moment “encouraged” to sign affidavits, dated today at George to the effect that all members of the selection panel preferred Mnyimba, and that no political instructions were received to recommend and appoint Mnyimba.

Well, well, well…

13h20. Die Cope-raadslid, John Maxim, is vanoggend gevra om ‘n beëdigde verklaring te onderteken dat die aanstellingskomitee eenparig by die raad aanbeveel het om Thandekile Myimba en Francois Human aan te stel.

Maxim het geweier.

Die ANC en sy kornuite, die kaders Mnyimba en Human, is duidelik bereid om die hof te mislei…

Intussen het OO verneem dat die ANC-raadslede George toe ontbied is vir samesprekings wat verband hou met die hofsaak wat môre begin.

16h35. Advocate Shaheed Patel is acting for the Municipality, after the Mayor’s choice as legal advisor, Mr Hardy Mills, of Mills & Lombard, of Plettenberg Bay, botched the initial response to the action.

The MM, Thandekile Myimba personally attended Court today. The matter is of the utmost importance to Mnyimba whose very appointment hangs upon the outcome.

Patel is currently being investigated by the George Council for billing discrepancies relating to bills rendered to George and Oudtshoorn.

OO is in possession of a 193-page report on the matter, dated November 12, 2011.

In the mean time, Mills was ordered by the Cape Law Society today not to use the name Mills & Lombard as he is not a director of Lombard’s firm.

12h30. The High Court this morning refused to grant the municipality any postponement in the Paulse case.

The municipality was ordered to file by the end of the Court day tomorrow, Tuesday.

The case will proceed on Wednesday.

OO sms’d the Municipal Manager, Thandekile Mnyimba, at 10h40: “Mnyimba, the Paulse application can cost ratepayers millions and your lawyers aren’t ready!? What are you doing, man!?”

Of course, no reply!

If the municipality can not even answer to the High Court, why would they respond to an OO enquiry?

10h25. OO has just learned that the municipality served papers on Allen Paulse late Friday to the effect that it will appraoch the High Court this morning to apply for an indefinite postponement in the Allen Paulse application as the municipality’s Heads of Argument are not ready.

Paulse and the Western Cape Minister for Local Government are opposing this application for postponement.

The municipality has threatened to simply not appear on Wednesday!

A ruling is expected this morning.

If Paulse wins the Oudtshoorn ratepayers may need to pay him out for a 5 year contract – some R5m!

And who do ratepayers have to thank for this latest crisis? The ANC Council under orders of Marius Fransman of course!

13h50. In a rather dramatic development in the Allen Paulse vs Oudtshoorn Municipality et al, the Western Cape Minister of Local Government has joined Paulse’s action and lodged papers with the High Court in support of Paulse’s application to have the appoinment of Thandekile Mnyima as Municipal Manager set aside, and in the alternative to have the appointment of Francois Human as Director Corporate Services set aside.

Paulse argues in papers before the Court that Mnyimba’s appointment was clearly fraught with reviewable irregularities.

The decision to appoint Mnyimba, says Paulse, was based on misinformation and irrelevant considerations.

“A more obvious case of political manipulationand machinations, aimed at procuring the appointment of a lesser qualified but politically preferred municipal manager at the expense of a better qualified candidate, is difficult to conceive”, says Paulse in a letter to Bredell on December 8 last year.

The Council botched its initial response to the action quite spectacularly and again asked for a potsponement of the matter subsequent to the Minister’s joining.

On a lighter note OO has not yet been able to confirm that Anton Bredell’s energy expending in joining this application has resulted in his ministry leapfrogging Eskom as the planet’s second biggest polluter among power companies (210mt of CO2 per annum).

  1. As jy wil en beoog om vir die hof te lieg, en ander nog vra om saam te lieg, vir wie sal jy nog lieg en oor wat? Kiessers en wat van eggenoot? ek hoop die word verder gevat!

    Daars lankal nie meer plek vir onbevoedes op derde vlak regering nie.
    My – hamba, rather go try your hand at National level, there it will still be tolerated.

  3. Met graad 6 mag jy maar foute maak, en val vir a special van Patel and cousens, maar nie op belasting betaalers se koste nie. Mag so lank wees en foute van n std4 kind maak, maar hy moet hom soos n VIP gedrae en soos n volwase verantwoording aanvaar vir sy dade.

  4. Oops! Looks like old Hardy’s plan B – to hop onto the Oudtshoorn Gravy Train – after being unceremoniously shoved off the Bitou Train has run into some trouble. Has this guy ever managed to file anything on time? What do Bitou and Paulse have in common? Both FIRED Mills!! As ek ‘n voorspellinkie kan maak… Pap en water is jou voorland, Hardy.

  5. THE ANC MUST PAY – It was their cadre deployment devoid of any procedural correctness or democracy!

    Dammit, we gave pietersen nigh on R2.5 Million cause the ANC thought he was their prophet, (pun intended) and now ratepayers might have to cough up for mnyimba whom came in from the wasteland of Jansenville to defoliate our fine Town – just cause the ANC said so??

    What’s he done since spewing “transparency and working together statements” on his arrival?

  6. As die BELASTING BETAALERS moet betaal kan ons dit trug eies van die “geleerde” raads lede? Die wat nietoe openlik kapsie gemaak het nie is saam skuldig. (R5,000,000/23=maat net so R217,000 elk)

  7. Snaaks as sy agterstewe aan die lyn is, hoe vinnig kan hy reageer? Wonder net wie gaan die kalklig wil kaap?

  8. Bredell a change of heart ? Wat wou ! Wonder wat Previn Gordhan se debat op SAFM vanoggend daarmee t e doen gehad het waar Gordhan se om beter dienslewering te verseker, nepotisme, ongekwalifiseerde staf aanstellings en korrupsie nie langer kan voorgaan. Is dit dus die ANC wat hier die voortou neem en die DA lei, of is dit omdat BREDELL kon nog nooit werklik leiding kon gee nie ?

  9. ….And I thought it was Bredell’s job to take an interest – nay duty – in the affairs and quality of the WC Government and the suitability of Public Servants, even at the humble level of Municipalities, and not to “bandwagon” and “upstage” mere private citizens endeavors to protect their rights and highlight political gerrymandering at the expense of “Service Delivery” and tax payers money?

    Ag fooi tog Bredel, come “join with us” sometime in Oudtshoorn – we have lots of “things” you can upstage and earn brownie points on!
